Course Description:
This course is designed to provide construction
professionals with information on debt collections from a debtors
point of view. This information extends from learning how to Fair Debt
Collection Practices Act can protect against unfair collections practices to
reviewing the process of defaulting on debts.
Course Learning Objectives:

familiar with what happens during debt collections,

Outline
what a collector can and cannot do,

Discuss
how the goals of the debtor are different from those of the collector,

Review
the process of litigation should compromise fail.
Course Outline:
Section 1- Fair Play- Familiarizes the licensee with
terminology used during debt collections. Teaches how the Fair Debt Collections
Practices Act can protect a debtor from abusive collections practices. Discusses the variability of state rules that may affect defensive
strategies. Describes a creditors plan and his major
moves including the process of litigation.
Section 2- Describes the Fair Debt Collections
Act and outlines the prohibited moves that the debt collector may attempt to
make. Discusses individual state laws and their variability
from state to state. Gives information on how a
complain can be filed against collectors who make advances on a debtor
that are considered illegal by state or federal law.
Section 3- Discuss the difference between the creditors goals and the debtors goals. Reviews asset
ownership and exemptions and looks at the benefits of having the assistance of
an attorney.
Section 4- Reviews the
process of defaulting on debts and the offensive moves of a debt collector.
Discusses how likely it is to reach a compromise and what to do during the process
of litigation should compromise fail. Gives information on
entering a judgment if a creditor prevails in litigation.
Method of
Presentation: This is an online course, which uses
narrated and animated PowerPoint Presentations that have been converted to Flash for web delivery.
Evaluation Method:
Licensees
will be evaluated on their comprehension of the material covered by
administering three to five (3-5) short learning exercises, interspersed
throughout the course in which participation is required.
